Terms of service

These Terms of Service ("Terms") govern all use of raceparts-depot.com (the "Site") and every purchase from Race Parts Depot ("RPD," "we," "us"). By using the Site, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or purchase from us.

1. What we sell

RPD sells used and reconditioned competition automobile parts removed from race cars. Every part is sold with a published condition grade. These are motorsport components: they have been used in competition unless expressly graded New/NOS.

2. AS-IS SALE — DISCLAIMER OF WARRANTIES

ALL PARTS ARE SOLD "AS IS" AND "WITH ALL FAULTS." THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF EACH PART IS WITH THE BUYER. SHOULD A PART PROVE DEFECTIVE FOLLOWING PURCHASE, THE BUYER — NOT RPD — ASSUMES THE ENTIRE COST OF ALL SERVICING OR REPAIR. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RPD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Condition grades are good-faith descriptions based on our inspection; they are descriptions, not warranties of future performance.

3. Off-highway competition use only — assumption of risk

Parts sold by RPD are for off-highway, closed-course motorsport use only and are not represented as compliant with any street-use, emissions, or safety standard. Motorsport is inherently dangerous and can result in serious injury, death, and property damage. By purchasing, you acknowledge these risks and voluntarily assume all risk arising from the purchase, installation, modification, use, or failure of any part, including use in competition.

4. Inspection and installation

You are responsible for inspecting every part before use. Safety-related components — including brakes, suspension, steering, wheels, and hubs — should be inspected and installed by a qualified race shop, and crack-tested or otherwise non-destructively inspected where appropriate, before any use.

5. Fitment

Factory part numbers and fitment references are provided for identification only. You (or your race shop) are solely responsible for verifying the part number against your car before ordering. Our return obligations do not extend to buyer fitment errors where the listing's part number was accurate.

6. Orders, quotes, and pricing

Listings marked "Pricing pending" are invitations to request a quote, not offers. All orders are subject to acceptance and availability; we may cancel and refund any order placed on a mispriced or unavailable listing.

7. Shipping and risk of loss

Risk of loss remains with RPD until the carrier records delivery. If a part arrives damaged, notify us within 5 days of delivery with your order number and photos of the part and packaging, and we will resolve it (replacement where possible, or a refund of the item price).

8. Returns

Because condition is disclosed up front, all sales are final, except where a part arrives materially not as described or damaged in transit — see our Refund Policy. Claims must be made within 5 days of delivery.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RPD'S TOTAL LIABILITY ARISING FROM ANY PART OR THESE TERMS IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID RPD FOR THAT PART, AND RPD IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST RACE ENTRIES, VEHICLE DAMAGE, OR PERSONAL INJURY ARISING FROM COMPETITION USE). Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited by law. Some jurisdictions do not allow certain limitations; in those jurisdictions, these limits apply to the fullest extent permitted.

10. Indemnification

You will defend, indemnify, and hold RPD harmless from third-party claims arising out of your installation, modification, resale, or use (including competition use) of any part purchased from RPD.

11. Trademarks

Race Parts Depot is an independent seller of genuine used parts. We are not affiliated with, sponsored by, or endorsed by Dr. Ing. h.c. F. Porsche AG or any vehicle manufacturer. Manufacturer names, model designations, and part numbers are used solely to identify parts and their fitment. Factory parts diagrams, where shown, are reproduced solely for component identification; all rights remain with their owners.

13. Governing law and venue

These Terms are governed by the laws of the State of California. Any dispute arising from these Terms or a purchase will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

14. General

If any provision of these Terms is held unenforceable, the remainder stays in effect. These Terms plus your order confirmation are the entire agreement for your purchase. We may update these Terms prospectively; the version posted at the time of your order governs that order.
